First instance verdict of VN Pharma case requested to be cancelled

NDO - The People’s Procuracy of Ho Chi Minh City on September 22 decided to appeal the case file of the pharmaceutical company VN Pharma and requested the cancellation of the entire first instance verdict of the case by the Ho Chi Minh City People’s Court.

The Ho Chi Minh City People’s Procuracy stated that the first instance verdict of VN Pharma has shown the signs of missing criminal acts and the examinations results of the Health Ministry is inconsistent and not compliant with legal regulations and does not represent real situation of the case.

In addition, the city People’s Procuracy stated that it is necessary to clarify the amount of the VND7.5 billion (US$330,000) spent on commission payment at hospitals that the defendants raised during the investigation.

The city People’s Procuracyrecognised that the first instance verdict of the People’s Court on defendant Nguyen Minh Hung (VN Pharma’s chairman of the Board of Directors cum general director) and his accomplices was incomplete, therefore, the city People’s Court was required to cancel the first instance verdict of the case for further investigation and to hold a re-trial.

According to the first instance verdict, the Ho Chi Minh City People’s Court sentenced Nguyen Minh Hung and Vo ManhCuong (director of H&C International Marine Trade company) to 12 years behind bars for smuggling.

The verdict also recommended that the Ministry of Public Security and the People’s Procuracy to carry out investigations in order to clarify the responsibilities of some of the related individuals, the payment of commissions to doctors, and the responsibilities of the Drug Administration of Vietnam under the Health Ministry.
